Terms of Service

This website is operated by Distal. Throughout this site, the terms “Distal,” “we,” “us,” and “our” refer to Distal.

Distal operates this website and offers the information, products, features, and services available through it to you subject to these Terms of Service (“Terms”).

By visiting our website, placing an order, or otherwise using our website or services, you agree to be bound by these Terms, together with any additional policies referenced here or made available through the website, including our Privacy Policy, Return Policy, and Shipping Policy.

Please read these Terms carefully before using the website. If you do not agree to these Terms, you should not use the website or purchase products from Distal.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform through which we offer our products.

1. Eligibility and online store terms

By using this website, you represent that you have the legal capacity to enter into a binding agreement in your jurisdiction. You may not use the website or our products for any unlawful or unauthorized purpose, and you may not violate any applicable law through your use of the website. You must not introduce malicious code, viruses, automated attacks, scraping systems, or other technologies intended to damage, interfere with, extract from, or disrupt the website or its operation. We may suspend or restrict access to the website when reasonably necessary to protect Distal, our customers, our systems, or third parties.

2. Distal products

Distal designs and sells physical objects and accessories for storage, ritual, organization, and display. You are responsible for using our products lawfully. Distal does not encourage or authorize unlawful use of its products.

3. Product information

We make reasonable efforts to display and describe our products accurately. However, photographs, videos, renderings, measurements, colors, textures, finishes, and other visual representations may appear differently depending on lighting, screens, manufacturing processes, materials, and other conditions. Minor variations may occur between individual physical objects, particularly where products involve small-batch manufacturing or finishing processes; these variations do not necessarily constitute defects. Product dimensions and specifications are approximate unless expressly stated otherwise. We may modify a product’s design, materials, packaging, specifications, or included components from time to time, provided that any change does not materially alter an order already accepted without appropriate notice to the customer.

4. Orders

Submitting an order does not necessarily mean that we have accepted it. After receiving an order, we may review it for payment authorization, inventory availability, suspected fraud, pricing errors, shipping restrictions, or other legitimate reasons. We reserve the right to decline or cancel an order before fulfillment where reasonably necessary, including when a product is unavailable, payment cannot be authorized, order information appears inaccurate or fraudulent, an obvious pricing or listing error occurred, we cannot lawfully ship to the destination provided, or fulfillment has become commercially or practically impossible. If we cancel an order after payment has been collected and before the product has been fulfilled, we will refund the amount paid for the cancelled portion. We may limit quantities purchased by a single customer, household, payment method, account, or shipping address when reasonably necessary to prevent fraud, unauthorized resale, or abuse.

5. Made-to-order and limited production

Certain Distal products may be produced, finished, assembled, or prepared after an order is placed. If a product is described as made to order, crafted to order, limited production, preorder, or otherwise subject to a stated production period, any estimated production or fulfillment timeframe displayed on the product page or communicated at purchase is an estimate unless expressly guaranteed. Reasonable production delays may occur. If a material delay affects your order, we may contact you with updated information or any options available to you. 6. Prices and payment

Prices displayed on the website are subject to change without notice. The price applicable to an accepted order is generally the price displayed at the time the order is submitted, except in the event of an obvious error. Taxes, shipping charges, duties, import charges, and other applicable fees may be added where required and will be disclosed at checkout. You agree to provide current, complete, and accurate billing, payment, shipping, and account information, and represent that you are authorized to use the payment method provided. We may correct typographical, pricing, promotional, or other errors and may cancel an affected order where displayed information was clearly incorrect.

7. Shipping and delivery

Shipping methods, estimated delivery times, processing periods, geographic restrictions, and related conditions are described in our Shipping Policy and at checkout. Delivery dates are estimates unless expressly stated otherwise. Once an order has been transferred to a shipping carrier, circumstances outside Distal’s reasonable control may affect delivery. Customers are responsible for providing an accurate and deliverable shipping address; additional charges resulting from an incorrect address, refused shipment, failed delivery, customs issue, or other circumstance attributable to the recipient may be the customer’s responsibility to the extent permitted by law. Nothing in this section limits rights that cannot legally be excluded.

8. Returns, refunds, and damaged products

Returns and refunds are governed by our Return Policy, which forms part of these Terms. Please review it before purchasing. If an item arrives damaged, defective, materially different from what was ordered, or incorrect, contact us promptly at distalnewyork@gmail.com so we can evaluate the issue and provide an appropriate remedy. Nothing in our Return Policy or these Terms limits any consumer right or remedy that cannot legally be waived.

9. Promotions and discounts

Promotional codes, discounts, gifts, credits, or other promotions may carry additional conditions disclosed with the promotion. Unless otherwise stated: promotions cannot be combined, have no cash value, may expire, may apply only to eligible products, and may be modified or withdrawn before an eligible order is placed. We may reject promotional offers obtained through fraud, technical exploitation, unauthorized distribution, or other abuse.

10. Intellectual property

The website and its contents — including our name, trademarks, logos, wordmarks, product names, product designs, photographs, films, artwork, graphics, typography, written copy, website design, layouts, concepts, and illustrations — are owned by or licensed to Distal and protected by applicable intellectual property law. Access to the website does not grant ownership of or a license to commercially exploit Distal intellectual property. You may view the website for personal, non-commercial purposes. Unless we provide prior written permission, you may not reproduce, distribute, sell, license, modify, publish, commercially exploit, scrape, systematically extract, or create unauthorized derivative works from Distal content.

11. User submissions and communications

If you voluntarily send us ideas, suggestions, feedback, images, messages, or other material, you represent that you have the right to provide that material and retain any rights you may have in it. Where necessary for us to respond to, display, process, or otherwise use material you intentionally submit for that purpose, you grant Distal a non-exclusive license to use it for that purpose. Nothing here prohibits you from providing an honest review, opinion, or assessment of Distal.

12. Prohibited uses

You may not use the website for unlawful purposes; to solicit unlawful acts; to violate intellectual property rights; to harass, abuse, threaten, or harm others; to submit intentionally false or misleading information for fraudulent purposes; to distribute malicious software; to collect others’ personal information unlawfully; to spam, phish, scrape, or crawl in violation of law or these Terms; to interfere with website security; to circumvent access or purchasing controls; or to engage in fraudulent transactions.

13. Third-party services

Our website may rely on or link to services operated by third parties, including Shopify, payment processors, shipping carriers, analytics providers, and social platforms, which may be governed by their own terms and privacy practices. Distal is not responsible for third-party websites, services, or content we do not control, except where responsibility cannot legally be excluded.

14. Privacy

Our collection and use of personal information is governed by our Privacy Policy. Because our store is hosted through Shopify, information may also be processed by Shopify and other service providers necessary to operate the store, process payments, prevent fraud, and fulfill orders.

15. Website availability

We aim to keep the site available and accurate but do not guarantee uninterrupted, error-free access. We may update, modify, suspend, or discontinue parts of the website for maintenance, security, development, or other legitimate business reasons.

16. Information on this website

Content published by Distal is provided for general informational, commercial, and artistic purposes. Where information on a product page or at checkout materially conflicts with general website content regarding an order, the more specific order-related information generally controls.

17. Disclaimer of warranties

To the fullest extent permitted by law, the website is provided on an “as available” basis, without guarantee of uninterrupted or error-free operation. Any warranties applicable to physical products are subject to applicable law and any express warranty specifically provided by Distal. Nothing here excludes warranties, rights, or remedies that cannot legally be excluded.

18. Limitation of liability

To the fullest extent permitted by law, Distal and its owners, officers, employees, contractors, affiliates, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from your use of, or inability to use, the website. Where liability relating to a purchase may legally be limited, Distal’s aggregate liability from that purchase will not exceed the amount paid for the product giving rise to the claim.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Distal and its affiliates, owners, officers, employees, and agents from third-party claims, losses, or expenses arising directly from your unlawful misuse of the website, violation of these Terms, or infringement of another party’s rights.

20. Severability

If any provision is determined unlawful, void, or unenforceable, it will be enforced to the maximum extent permitted by law and, where necessary, severed — the remaining provisions continue in effect.

21. Waiver

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

22. Entire agreement

These Terms, together with our Privacy Policy, Return Policy, Shipping Policy, and any policies expressly incorporated into them, constitute the entire agreement between you and Distal.

23. Governing law

These Terms and any transaction between you and Distal are governed by the laws of the State of New York and applicable federal law, without regard to conflict-of-law principles, except where your jurisdiction requires otherwise. Nothing here prevents a consumer from exercising rights available under mandatory consumer-protection law.

24. Changes to these terms

We may revise these Terms from time to time. The current version is published on this page with an updated effective date. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.

Shipping Policy

This Shipping Policy applies to purchases made through Distal. By placing an order, you acknowledge the applicable processing, preorder, fulfillment, and delivery terms described below.

Preorders. Certain Distal products, including Solace, may be offered for preorder before official release. Unless otherwise stated on the product page, payment is collected in full at checkout. Solace is currently expected to release in late 2026 — an estimate, not a guaranteed date. Preorders will not ordinarily enter final fulfillment until Solace is officially released; processing for shipment begins after release.

Preorder processing. Preorders generally require approximately 1–5 business days of processing after official release before shipment (separate from carrier transit time), though this can extend due to order volume, production scheduling, manufacturing delays, material or packaging availability, assembly/finishing, quality control, fulfillment capacity, order verification, or carrier availability. Orders may ship in batches and not strictly in the order placed.

Release and shipping delays. All timelines are estimates unless expressly guaranteed in writing. Distal reserves the right to revise estimated timelines when reasonably necessary due to circumstances including manufacturing/supplier delays, material shortages, product revisions, quality-control needs, unexpected demand, transportation disruptions, labor interruptions, severe weather, natural disasters, governmental action, supply-chain issues, or infrastructure/technology failures. Distal may delay fulfillment rather than ship an incomplete or defective product. A delay does not automatically mean an order is cancelled; where law requires notice, revised information, a consent-to-delay option, cancellation, or refund, we will provide it.

Complete order fulfillment. Solace may include multiple components produced or supplied separately. An order will generally ship once the required components are ready; Distal may hold an order until complete or divide it into multiple shipments at its discretion, without imposing extra shipping charges solely for that reason (unless the customer requests an additional or expedited shipment).

In-stock orders. After official release, in-stock orders generally begin processing once placed and payment is authorized; weekend/holiday orders may begin processing the next business day.

Shipping methods and rates. Available methods and charges display at checkout and may vary by destination, shipment size/weight, carrier, and delivery method. Distal may change carriers where reasonably necessary.

Delivery times. Carrier transit begins once an order is handed to the carrier. Any delivery estimate is not a guaranteed date unless expressly identified as guaranteed. Distal is not responsible for delays from circumstances outside its reasonable control once a shipment is with the carrier, except as required by law.

Shipping confirmation and tracking. A shipping confirmation with tracking is generally sent to the order’s email address when available; tracking may not update immediately after a label is created.

Shipping addresses. You’re responsible for providing complete, accurate shipping information — review it before checkout. Errors found after ordering: email distalnewyork@gmail.com; we’ll make reasonable efforts to update the address but cannot guarantee changes once processing or shipment has begun. Distal is not responsible for losses from inaccurate customer-supplied information, except as required by law. If an order is returned due to an incorrect address, refusal, failed delivery attempts, or similar, the customer may be responsible for reasonable reshipping costs.

Lost shipments. If tracking suggests a shipment was lost in transit, email distalnewyork@gmail.com; we may need reasonable time to investigate with the carrier before issuing a replacement or other resolution.

Packages marked delivered. If tracking shows delivered but you can’t locate the package, check the delivery location, mailroom/reception, nearby entrances, household members, building staff, and neighbors, then contact distalnewyork@gmail.com. We’ll assist with any available carrier investigation; Distal reserves the right to review the circumstances before providing a replacement, refund, or other resolution.

Damaged shipments. If an order arrives visibly damaged, defective, or materially compromised, contact distalnewyork@gmail.com promptly with your order number and, where possible, photos of the product, shipping package, shipping label, and the damage. We may request that damaged goods/packaging be retained during review, and may provide a replacement, refund, repair, or other appropriate remedy.

International shipping. Distal ships only to destinations made available at checkout. Where international shipping is offered, customers may be responsible for duties, import taxes, customs charges, or brokerage fees imposed by the destination jurisdiction unless otherwise stated; these are generally outside Distal’s control and not included in the product price unless expressly stated. Customers are responsible for determining whether products may legally be imported into and possessed in their destination jurisdiction.

Force majeure. To the fullest extent permitted by law, Distal is not in breach of an estimated timeframe due to delays from events reasonably outside its control (severe weather, natural disasters, fire, flood, epidemic/pandemic, war, civil disturbance, government action, transportation interruptions, labor disputes, carrier disruptions, supplier failures, manufacturing interruptions, shortages, or infrastructure failures), and may reasonably extend affected timelines while such circumstances continue. Any legally required customer notice, consent, cancellation, or refund rights remain unaffected.

Returns, cancellations, and refunds. Governed separately by Distal’s Return Policy below, subject to applicable law.

Changes to this policy. Distal may update this Shipping Policy from time to time; changes apply prospectively to the extent required by law. The terms communicated in connection with a specific order govern that order.

Return Policy

14 days from delivery to request a return.
Solace must be unused, unmarked, complete, and returned in its original packaging.
Opening the package to inspect it is fine. Actually using the object isn’t.
Customer pays return shipping for change-of-mind returns.
Refund goes back to the original payment method after inspection.
No restocking fee.
If the object arrives damaged, defective, or incorrect, Distal covers everything and offers replacement or full refund.
